Agreement to Terms
These Terms and Conditions ("Terms") constitute a legally binding agreement between you — whether as an individual or on behalf of an entity ("you") — and CyberSec ("Company," "we," "our," or "us") governing your access to and use of our website, services, and products.
By accessing or using any of our services, you confirm that you are at least 18 years of age, have the legal capacity to enter this agreement, and accept these Terms in their entirety. If you do not agree, you must cease use of our services immediately.
Important: These Terms include a limitation of liability clause and a binding arbitration provision. Please read them carefully before proceeding. Your continued use of CyberSec services constitutes acceptance of any updated Terms.
Our Services
CyberSec provides cybersecurity services, software products, and related professional services including but not limited to vulnerability assessment, penetration testing, security consulting, game development, and AI solutions.
Cybersecurity Services
penetration testing, security audits, and incident response services subject to individual service agreements and scoping documents.
Software Products
Licensed software products are subject to their respective End User License Agreements (EULAs) which supplement these Terms.
Professional Services
Consulting, development, and managed services are governed by separate Statement of Work (SOW) agreements executed between the parties.
We reserve the right to modify, suspend, or discontinue any service at any time with reasonable notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuation of services.
User Accounts
Certain features of our services may require account registration. You agree to provide accurate, complete, and current information and to maintain it accordingly. Account security is your responsibility:
- You are responsible for maintaining the confidentiality of your credentials and all activities under your account
- You must notify us immediately at security@cybersec.com upon discovering any unauthorized access
- You may not share accounts, use another person's credentials, or create accounts by automated means
- We reserve the right to disable accounts that violate these Terms or compromise platform security
Acceptable Use Policy
Our services are provided for lawful, authorized purposes only. You expressly agree not to:
- Use our services to conduct unauthorized testing, scanning, or probing of systems you do not own or have explicit written authorization to test
- Develop, deploy, or distribute malware, ransomware, or any malicious software using our infrastructure or knowledge
- Reverse-engineer, decompile, or disassemble any of our software or proprietary tools
- Attempt to circumvent, bypass, or disable any security controls on our platforms
- Use our services in connection with any illegal activity, fraud, or violation of third-party rights
- Resell, sublicense, or provide access to our services to unauthorized third parties
- Introduce viruses, trojans, or other malicious code into our systems or networks
All penetration testing and security assessment services are conducted only against systems for which you have provided documented, written authorization. Misrepresentation of authorization scope is grounds for immediate termination and potential legal action.
Intellectual Property
All content, software, methodologies, tools, and materials associated with CyberSec services are protected by applicable intellectual property laws. Ownership is allocated as follows:

You may not reproduce, distribute, or create derivative works from our proprietary materials without prior written consent. Violation of intellectual property provisions may result in immediate termination and legal action.
Payment Terms
Fees for our services are specified in proposals, quotes, or subscription agreements. Unless otherwise stated:
- Invoices are due within 30 days of the invoice date unless a different term is negotiated in writing
- Late payments accrue interest at 1.5% per month (18% per annum) or the maximum rate permitted by law
- Subscription services renew automatically unless cancelled at least 14 days prior to renewal date
- Refunds for prepaid services are available on a pro-rated basis for unused periods, excluding setup or onboarding fees
- We reserve the right to suspend services for accounts 15 or more days overdue without notice
- Disputed invoices must be raised in writing within 10 days of receipt — undisputed portions remain due
Limitation of Liability
To the maximum extent permitted by applicable law, CyberSec shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including loss of profits, data, goodwill, or business interruption — arising from your use or inability to use our services, even if advised of the possibility of such damages.
Cap on Liability: Our aggregate liability for any claims arising under these Terms shall not exceed the greater of (a) the amount you paid to us in the twelve months preceding the claim, or (b) $1,000 USD. This limitation applies regardless of the theory of liability.
Some jurisdictions do not permit the exclusion or limitation of implied warranties or incidental damages. In such jurisdictions, our liability is limited to the greatest extent permitted by applicable law.
Indemnification
You agree to defend, indemnify, and hold harmless CyberSec and its officers, directors, employees, contractors, agents, licensors, and suppliers from any claims, liabilities, damages, judgments, awards, losses, costs, or expenses (including reasonable legal fees) arising from:
- Your violation of these Terms or any applicable law
- Your use of our services in an unauthorized or unlawful manner
- Your infringement of any third-party intellectual property or other rights
- Any misrepresentation of authorization scope in security testing engagements
- Content or data you submit to or process through our platforms
Termination
Either party may terminate service agreements by providing written notice per the terms of the applicable agreement. We reserve the right to terminate or suspend access immediately and without notice if:
- You breach any provision of these Terms or any supplemental agreement
- We determine your conduct poses a legal, reputational, or security risk to CyberSec or third parties
- You become subject to insolvency proceedings, bankruptcy, or cease to operate as a going concern
- We are required to do so by applicable law or regulatory authority
Upon termination: your access to services ceases, outstanding payments become immediately due, and provisions that by their nature should survive termination (including intellectual property, liability, and indemnity clauses) shall continue in full force.
Governing Law & Dispute Resolution
These Terms are governed by and construed in accordance with applicable commercial law. For disputes between parties, we commit to the following resolution process:
Step 1 — Informal Resolution
All disputes must first be raised in writing. Both parties agree to negotiate in good faith for 30 days before pursuing formal proceedings.
Step 2 — Mediation
If informal resolution fails, parties agree to non-binding mediation with a mutually agreed mediator before escalating to arbitration or litigation.
Step 3 — Binding Arbitration
Unresolved disputes shall be settled by binding arbitration under internationally recognized commercial arbitration rules. Class action waivers apply.
